Terms of Use

1. Acknowledgment

These Terms are concluded between you and the Licensor, and not with Apple Inc. ("Apple"). The Licensor, not Apple, is solely responsible for the Licensed Application and its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

2. Scope of License

The Licensor grants you a limited, non-transferable, non-exclusive, revocable license to use the Licensed Application on Apple-branded devices that you own or control, in accordance with the Usage Rules set forth in the App Store Terms of Service. This license also applies to any updates provided by the Licensor that replace or supplement the original Licensed Application, unless such update is accompanied by separate terms.

You may not:

• distribute or make the Licensed Application available over a network
• transfer, sublicense, or redistribute the Licensed Application
• copy, modify, reverse engineer, disassemble, or create derivative works

3. Maintenance and Support

The Licensor is solely responsible for providing maintenance and support services for the Licensed Application, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. Subscriptions and Billing

The Licensed Application offers auto-renewable subscription options.

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Subscription pricing is displayed within the application and may vary by region.
• You can manage or cancel your subscription in your App Store account settings.

5. Consent to Use of Data

You agree that the Licensor may collect and use technical data and related information, including but not limited to information about your device, system, and application software, to facilitate updates, support, and service improvements.

The Licensed Application may also collect and process the following data when you use specific features:

• Location data — used to display your position on the map and provide nearby language practice scenarios
• Voice recordings — captured via the microphone during speaking practice, used for speech evaluation and feedback
• Conversation transcripts — text messages exchanged during AI and peer practice sessions

All data will be handled in accordance with our Privacy Policy.

6. AI-Generated Content

The Licensed Application uses artificial intelligence services (including OpenAI and ElevenLabs) to generate conversation responses, language evaluations, coaching feedback, and text-to-speech audio. AI-generated content is provided for educational purposes only and may contain errors or inaccuracies. The Licensor does not guarantee the correctness, completeness, or suitability of any AI-generated content.

7. Learn Together

Learn Together is a peer language practice feature that connects you anonymously with other learners. By using Learn Together, you confirm that you are at least 18 years old and agree to the following rules:

• Do not request or share exact locations, contact details, or social media handles
• Do not attempt to identify another learner or arrange offline meetings
• Do not send sexual, hateful, threatening, or otherwise abusive content
• Do not harass, spam, or impersonate other users

Messages may be moderated automatically. We reserve the right to warn, block messages, terminate sessions, restrict access to the feature, or suspend your account if these rules are violated. You may report, mute, or block other users at any time during a session.

8. Age Requirements

The Licensed Application is intended for users aged 13 and older. The Learn Together feature is restricted to users aged 18 and older. By using Learn Together, you represent and warrant that you are at least 18 years of age.

9. External Services

The Licensed Application may enable access to third-party services and content ("External Services"), including but not limited to map services, authentication providers, and payment processors. You acknowledge that use of such services is at your own risk. The Licensor is not responsible for the accuracy, availability, or content of any External Services. When using the Licensed Application, you agree to comply with any applicable third-party terms of agreement.

10. Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.

THE LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OF CONTENT
• NON-INFRINGEMENT

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Licensor.

11. Product Claims

The Licensor, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and use of the Licensed Application, including but not limited to:

• product liability claims
• any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
• claims arising under consumer protection, privacy, or similar legislation

12. Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

13. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION.

15. Termination

These Terms remain effective until terminated. Your rights will terminate automatically if you fail to comply with any provision of these Terms.

16. Governing Law

If you are located in the European Union or Serbia, these Terms shall be governed by the laws of your country of residence.
